This Privacy Policy explains how Ink'd LLC ("Ink'd," "we," "us," or "our") collects, uses, shares, and protects information in connection with the Ink'd platform, websites, applications, and related services (the "Services"). It applies to visitors to our websites, individuals who register for accounts, Authorized Users under team, brokerage, or enterprise accounts, and individuals whose information is contained in content processed through the Services.
Our Terms of Service describe the contractual terms that govern use of the Services and refer to this Policy as the description of our information practices. Capitalized terms not defined here have the meanings given in the Terms of Service.
1. Our Roles: When We Decide and When We Follow Instructions
Ink'd acts in two distinct capacities, and your rights differ depending on which capacity applies.
For Workspace Content — documents, contracts, voice and text inputs, and Outputs you create, upload, or generate — Ink'd generally acts as a processor or service provider on behalf of the customer that controls the applicable account. Ink'd processes Workspace Content to provide, secure, support, and maintain the Services in accordance with the customer's instructions, our agreements, and applicable law. Ink'd acts as an independent controller for limited account, billing, security, legal-compliance, and service-administration information where Ink'd independently determines the purposes and means of processing.
Where Ink'd and a business customer have entered into a data processing agreement, that agreement controls over this Policy with respect to the processing it covers.
For team, brokerage, and enterprise accounts, the account-owning customer designates Account Administrators who may access, manage, export, or delete Workspace Content within the account, to the extent those capabilities are made available in the Services.
Real estate documents routinely contain personal information about transaction participants — buyers, sellers, landlords, tenants, and others — who are not Ink'd users. We process that information solely as part of the Workspace Content, at the direction of our users. If you are a transaction participant with questions about information contained in a document, please contact the real estate professional or brokerage handling your transaction; we will direct any request we receive to the responsible account holder where appropriate.
2. Information We Collect
2.1 Information You Provide
- Account and profile information: name, email address, phone number, real estate license information, MLS number, brokerage name, brokerage address, brokerage phone number, team affiliation, and authentication credentials.
- Billing information: payment card or bank details, billing address, and transaction history. Payments are processed by our payment processor; we do not store full payment card numbers.
- Workspace Content: documents, contracts, prompts, files, and other materials you upload, submit, or generate through the Services, which may include personal information about you and about transaction participants.
- Voice input: if you use a voice-enabled feature, we process the audio you provide in order to transcribe it and generate the document or action you requested.
- Communications: messages you send to support, feedback, survey responses, and event registrations.
2.2 Information Collected Automatically
- Usage data: features used, documents created, pages viewed, actions taken, timestamps, and referral pages.
- Device and connection data: IP address, browser type, operating system, device identifiers, and general location inferred from IP address.
- Cookies and similar technologies, as described in Section 8.
2.3 Information from Third Parties
- Integration data: if you connect a third-party service to your account, we receive the information described in Section 6.
- Payment processor: confirmation of payment, subscription status, and fraud signals.
- Team and brokerage administrators: if you are added to a team or brokerage account, your administrator may provide your name, email, and role.
2.4 Sensitive Information
The Services are designed to process real estate transaction documents, which by their nature may contain personal and financial information about parties to a transaction. Submit that information only where it is needed for the document you are preparing and you have the right to use it. Do not include government identification numbers (such as Social Security numbers), full financial account numbers, or health information in Workspace Content unless the document genuinely requires it and you have any consent or other legal basis the information requires; where practical, redact identifiers a document does not need. Some categories of information may be restricted or prohibited by our Acceptable Use Policy.
3. How We Use Information
- Provide, operate, maintain, and secure the Services, including generating Output from your Input, subject to the limits in Sections 4 and 6;
- Set up and administer accounts, teams, and brokerage workspaces;
- Process payments, manage subscriptions, and send transactional messages (receipts, renewal notices, security alerts);
- Respond to support requests and communicate with you about the Services;
- Monitor, analyze, and improve performance, reliability, and usability of the Services;
- Detect, prevent, and address fraud, abuse, security incidents, and violations of our Terms of Service or Acceptable Use Policy;
- Send marketing communications about Ink'd products and features, which you may opt out of at any time; and
- Comply with legal obligations and enforce our agreements.
4. AI Features and Model Training
Certain features of the Services use artificial intelligence to generate or edit documents. When you choose to use an AI-enabled feature, the information you submit to that feature and the resulting Output are processed by our AI infrastructure and by the AI service providers identified in Section 5, acting on our behalf. Our commitments:
- We do not use Workspace Content — including prompts, uploaded documents, voice input, transaction information, and Output — to train, fine-tune, evaluate, or improve any artificial-intelligence model or similar system unless you provide separate, affirmative consent or the applicable enterprise agreement expressly authorizes the particular use.
- Our AI service providers are configured so that your content is not used to train their models, and human review of your content is disabled. AI processing occurs in the United States.
- We may use non-content service telemetry and genuinely de-identified or aggregated usage information to operate, secure, evaluate, and improve the Services. We maintain de-identified data without identifiers, take reasonable measures to prevent re-identification, commit not to attempt to re-identify it, and contractually require any recipient of de-identified data to do the same.
- Data received from a third-party integration is not submitted to AI systems where the applicable platform prohibits that processing, as described in Section 6.
- A master agreement or data processing agreement may provide additional or more restrictive commitments for a particular business customer. That agreement controls for the processing it covers.
6. Third-Party Integrations and Platform Data
The Services may make optional integrations with third-party platforms — such as transaction management, electronic signature, and storage services — available from time to time. When you connect an integration and direct us to do so, we send documents you have generated in Ink'd to your account on that platform. To route a document correctly, we receive limited account and transaction information from the platform, such as identifiers for your account and for the transaction file you select.
We use information received from a connected platform only to complete the transfer you requested. We do not submit it to AI features, we do not use it for product development, analytics, or advertising, and we do not disclose it to other parties, in each case where the applicable platform's terms prohibit that use — and we apply the platform's restrictions where they are more protective than the practices generally described in this Policy. We do not retain that information beyond what is necessary to complete the delivery you requested and to comply with law, and we do not retain it in de-identified form as a substitute for deletion. Your use of a connected platform remains governed by that platform's own terms and privacy policy.
You may revoke an integration through the controls made available by Ink'd or the applicable third-party platform. Revocation stops future access through the integration but may not automatically delete information previously received where retention is permitted or required.
7. Where We Process Information
We are based in the United States, and our infrastructure and AI processing are located in the United States. Wherever information is processed, we apply the safeguards described in this Policy.
9. Data Retention
We retain information for different periods depending on its category, as summarized below, and in each case as needed to comply with legal obligations, resolve disputes, and enforce agreements. Legal holds may extend these periods where required.

10. Security
We maintain administrative, technical, and organizational safeguards designed to protect personal information, taking into account the nature of the information, the purposes for which it is processed, and the risks associated with the processing. No system is completely secure, and we cannot guarantee absolute security. You are responsible for maintaining the confidentiality of your credentials and for activity under your account. If we discover a security incident affecting personal information, we will notify affected business customers, individuals, regulators, or other parties as required by applicable law and our contractual obligations.
11. Your Rights and Choices
11.1 All Users
- Access and update account information through account settings;
- Opt out of marketing emails using the unsubscribe link (transactional messages will continue);
- Revoke third-party integrations as described in Section 6; and
- Request deletion of your account by contacting legal@inkd.ai, subject to our retention obligations.
11.2 U.S. State Privacy Rights
Depending on your state of residence, you may have rights under state privacy law to access, correct, delete, or obtain a copy of personal data, and to opt out of targeted advertising, sale, or certain profiling. We honor verifiable requests to exercise these rights where they apply, and we will not discriminate against you for exercising them. To submit a request, contact legal@inkd.ai with the subject line "Privacy Request." We may need to verify your identity before responding, and we will respond within the time required by applicable law. If we decline a request, we will explain why.
11.3 Appeals
To appeal a decision concerning a privacy request, email legal@inkd.ai with the subject line "Privacy Appeal." We encourage you to submit an appeal within 30 days after receiving our decision, although we will accept later appeals where required by applicable law. Please identify the original request and explain why you believe the decision should be reconsidered. We will respond within the period required by applicable law, and where law requires, we will tell you how to contact your state attorney general if you are dissatisfied with the appeal outcome.
11.4 Requests Concerning Workspace Content
Where a request concerns personal data contained in Workspace Content controlled by one of our customers, we will route the request to that customer and assist the customer in responding, consistent with our agreements. The customer is responsible for deciding how the request is resolved with respect to content it controls.
Most state comprehensive privacy laws apply to individuals acting in a personal or household context and do not extend to information about individuals acting in a commercial or employment context. Because the Services are business tools for real estate professionals, some state-law rights may not apply to your use of the Services; we nevertheless accept and evaluate all requests as described above.
12. Children
The Services are not directed to children, and individuals under 18 may not create or administer an Ink'd account. Business customers may submit Workspace Content that contains information about minors — for example, occupant information in a lease. In those circumstances, Ink'd processes the information at the direction of the applicable customer, which is responsible for having an appropriate legal basis to provide it. If you believe a person under 18 has created an account, contact legal@inkd.ai and we will take appropriate steps to close the account and delete associated information, subject to legal, security, fraud-prevention, and record-retention requirements.
13. Changes to This Policy
We may update this Policy from time to time. If we make material changes, we will notify you by email or prominent notice within the Services before the changes take effect, unless immediate effectiveness is reasonably necessary to comply with law or address an urgent security or operational risk, and will update the effective date above. If a change materially affects how we use personal information previously collected, we will provide additional notice and obtain consent where required by applicable law or our agreements.
